Tutor Terms and Conditions

SECTION 1 - WHAT DO WE DO WITH YOUR INFORMATION?
When you signup to be an independent tutor with Tell Class, as part of the joining process, we collect the personal information you give us such as your name, address, contact number and email address, location, profile photo etc.
When you browse our school website, we also automatically receive your computer's internet protocol (IP) address in order to provide us with information that helps us learn about your browser and operating system.
Email marketing (if applicable): With your permission, we may send you emails, notifications about school updates, student booking information/updates and payment updates.


SECTION 1 - AGE OF CONSENT
By using this site as an independent Tutor, you confirm that you are at least 18 years old.

SECTION 2 - TELL CLASS IS A MARKETPLACE PROVIDER

You acknowledge that Tell Class is not in the business of providing tutoring services. Tell Class provides an online marketplace where Students and Tutors can connect.

Tutors are Independent Contractors. You acknowledge that Tutors are independent contractors operating an independent business enterprise who use the Platform to offer and provide Tutoring Services to Students. Tell Class is not an employer of any Tutor and will not be responsible for providing Tutors with company benefits such as paid leave, insurance etc.  Each individual independent contractor will be responsible for paying their own taxes. 

Tutors Provide Materials. You understand that, except as otherwise specifically agreed between Student and Tutor, Tutor will provide all equipment, tools, materials, and labour that he or she needs to perform the Tutoring Services agreed to with Student and that Tell Class will provide no equipment, tools, materials, or labour that may be needed to perform the Tutoring Services under this Agreement. Tell Class will, however, in its discretion, provide both Student and Tutor with access to the teaching Platform to facilitate access to available, optional support resources and materials.

SECTION 3 - PAYMENTS
All tutors will be paid from €3 to €5 per 25 minute lesson taught, depending on your residency.  Payment will be transferred by the 5th of the following month.

Payment Method: Each tutor will be paid via Wise.com and paid in Euro currency. All tutors are required to set-up a Wise account and create a Euro account for your salary to be paid into.

Please note: With each transfer from a tutor's Wise account to their personal bank account, Wise will ask you for a small conversion fee, this fee is payable by each individual tutor.

SECTION 4 - TUTOR RULES

No sharing of personal contact details. This includes telephone numbers, email addresses, social media accounts, surnames etc between tutors & students.

Tutors and Students are to respect each other in action and in speech. Any inappropriate language or sexual behaviour will not be tolerated on Tell Class and will be dealt with swiftly. All lessons are recorded for everyone's protection. Anyone violating these terms of service will have their account suspended immediate and may result in the termination of your account. (See Section 16 on Terms of Service for more information about Terminations).  You agree to "Red Flag" a lesson to report an issue to support should any inappropriate behaviour occur.

Be on time for lessons. All Tutors agree to be on time for booked lessons (At least 1 minute before the scheduled lessons). Should a Tutor arrive late or not arrive at all for the booked lesson, penalties will charged on their account.

Tutors availability. Each Tutor is responsible to manage their own availability.  

Mini Educational Video Lesson Submission. To assist Tutors in getting more exposure to more students, and to assist Tell Class in marketing the school, all Tutors can submit a 30 second - 1 minute mini language lesson.

SECTION 5 - VIDEO SUBMISSIONS, USER COMMENTS, FEEDBACK AND OTHER SUBMISSIONS
If, at our request, you send certain specific submissions (mini video language lessons) or without a request from us you send creative ideas, suggestions, proposals, plans, videos or other materials, whether online, by email, by postal mail, or otherwise (collectively, 'comments'), you agree that we may, at any time, without restriction, edit, copy, publish, distribute, translate and otherwise use in any medium any comments that you forward to us. We are and shall be under no obligation (1) to maintain any comments in confidence; (2) to pay compensation for any comments or videos; or (3) to respond to any comments or videos. We may, but have no obligation to, monitor, edit or remove content that we determine in our sole discretion are unlawful, offensive, threatening, libellous, defamatory, pornographic, obscene or otherwise objectionable or violates any party’s intellectual property or these Terms of Service. You agree that your comments will not violate any right of any third-party, including copyright, trademark, privacy, personality or other personal or proprietary right. You further agree that your comments, videos or materials will not contain libellous or otherwise unlawful, abusive or obscene material, or contain any computer virus or other malware that could in any way affect the operation of the Service or any related website. You may not use a false e-mail address, pretend to be someone other than yourself, or otherwise mislead us or third-parties as to the origin of any comments. You are solely responsible for any comments you make and their accuracy. We take no responsibility and assume no liability for any comments posted by you or any third-party.

SECTION 6 - THIRD-PARTY SERVICES
In general, the third-party providers used by us will only collect, use and disclose your information to the extent necessary to allow them to perform the services they provide to us.
However, certain third-party service providers, such as payment providers and other payment transaction processors, have their own privacy policies in respect to the information we are required to provide to them for your purchase-related transactions.
For these providers, we recommend that you read their privacy policies so you can understand the manner in which your personal information will be handled by these providers.

Once you leave our school’s website or are redirected to a third-party website or application, you are no longer governed by this Privacy Policy or our website's Terms of Service.

SECTION 7 - DISCLOSURE
We may disclose your personal information if we are required by law to do so or if you violate our Terms of Service. None of your personal contact information will be shared with students to protect your privacy.

SECTION 8 - DATA STORAGE
Our website and school database is hosted on the Tell Class servers. Your data is stored on Tell Class’s data storage, databases and the general Tell Class application. We store your data on a secure server behind a firewall. 

SECTION 9 - SECURITY
To protect your personal information, we take reasonable precautions and follow industry best practices to make sure it is not inappropriately lost, misused, accessed, disclosed, altered or destroyed. If you provide us with your credit card information, the information is encrypted using secure socket layer technology (SSL) and stored with a AES-256 encryption. Although no method of transmission over the Internet or electronic storage is 100% secure, we follow all PCI-DSS requirements and implement additional generally accepted industry standards.

SECTION 10 - COOKIES

What are cookies?

Cookies are simple text files that are stored on your computer or mobile device by a website’s server. Each cookie is unique to your web browser. It will contain some anonymous information such as a unique identifier, website’s domain name, and some digits and numbers.

Necessary cookies

Necessary cookies allow us to offer you the best possible experience when accessing and navigating through our website and using its features. For example, these cookies let us recognize that you have created an account and have logged into that account.

Functionality cookies

Functionality cookies let us operate the site in accordance with the choices you make. For example, we will recognize your username and remember how you customized the site during future visits.

These cookies enable us and third-party services to collect aggregated data for statistical purposes on how our visitors use the website. These cookies do not contain personal information such as names and email addresses and are used to help us improve your user experience of the website.

SECTION 11 - CHANGES TO THIS PRIVACY POLICY
We reserve the right to modify this privacy policy at any time, so please review it frequently. Changes and clarifications will take effect immediately upon their posting on the website. If we make material changes to this policy, we will notify you here that it has been updated, so that you are aware of what information we collect, how we use it, and under what circumstances, if any, we use and/or disclose it. If our store is acquired or merged with another company, your information may be transferred to the new owners so that we may continue to sell products to you.
